WHAT TYPES OF INHERITANCE DO WE HAVE IN GHANA??? 

  ILLEGAL LEASING OF TORGBE KOJO AMAGLO`S LAND

                                                                           Kojo Amaglo Family Secretariat                                                                                         Private Mail Bag 5                                                                                                                 Adidome, V /  R                                                                                                                       Tel: 0244585777 / 0242187811                                                                                               8th October, 2018.                                        Green Bounty Ltd,                                                                                                                  P.O Box 1383,                                                                                                                          Ho, 00233 Ghana.                                                                                                                                                                                                                                                                    Attention: Prof Francis Tetteh Koku Sefe.                                                                                                                                                                                                                   Dear Sir,                                                                                                                                               Re: Your recent request to lease Kojo Amaglo Family lant at Meyikpor for                                 the establishment of a mixed agriculture enterprise.                                                                                                                                                                                We write to acknowledge your approach to the Kojo Amaglo Family, which                  represented by the above under-signed, with the proposal to develop a mixed            agriculture enterprise on the Kojo Amaglo Family Land at Meyipkor.                                                                                                                                                                                  We have considered your proposal and have resolved as a family to agree to your request  to use our land. We wish to state that the land is available to Green Bounty Ltd  for use under the following terms and conditions:                                                                                                                                                                                                        1. Lease period-----50 years renewable by mutual consent for a further period. he size of the land is 245 acres.  ( an accurate measurement of the land will carried out later by a qualified surveyor and a site plan prepared and appended to the                   eventual  lease agreement.)                                                                                                   2. Lease rate    - GHC 50 per year.                                                                                       3. The total value of the lease is GHC 612,000 over 50 years.                                           4. Commencement  - The lease shall commerce on 1st January 2019.                             5. Moratorium        - 1 year ( to December 2019)                                                               6. Kojo Amaglo Family would like 40% of the 50- year leas which amounts to               GHC  245,000 to be paid as cash over the 3-years starting from 2020 and finishing      in 2022. The amount shall been paid in 6 equal installment over the 3-year                  period.The payment dates shall be 30th January and 30th June of each of those 3        years.The payment due at each period amounts to GHC 40,833.33                                   7. The remainder of the lease amount is GHC 367, 500.00. The Kojo Amaglo Family would like this amount to be taken as their equity investment into the project for a      consideration of 15% of shares in the business at Meyikpor Farm.                                   8.Green Bounty Ltd shall keep a separate  ledger of accounts for the Meyikpor farm 9.Green Bounty Ltd would exercise overall management  and  technical  authority      over the project.                                                                                                                       10. Green Bounty Ltd is permitted to carry out any construction work on the land        in pursuit of its project scope and objectives. The structures may be permanent or        temporary, movable or immovable.                                                                                      11. The Kojo Amaglo family shall not be required to fund or contribute to funding      of any structure on the farm.                                                                                                12. A 24- month notification period shall apply to intent to renew or intent to              terminate the lease.                                                                                                                13. Upon termination for whatever reason, Green Bounty Ltd would remove all          removable assets including livestocks and machinery/vehicles. Capital structures such as dam and boreholes and buildings will be transferred to the Kojo Amaglo family at a price to be negotiated by the parties.                                                                                14. Green Bounty Ltd shall prepare  an MOU that will the commercial relationship    between the parties and a lease agreement over the land. Both documents will be        signed in due course by the parties.                                                                                                                                                                                                                                        Finally,we wish to reiterate our commitment  to the proposed project and express        our desire to be your partner.  Ghana is not autocracy or autocratic country, aristocracy or aristocratic country, plutocracy or plutocratic country, kakistocracy nor a dictatorship or revolutionary country but  a democracy or  democratic country. A political theory or doctrine being  formulated and advocated by an  illustrious late  president of United States of America  known as Abraham Lincoln, and is   defined as a rule of the people, by the people and for the people.                                                                                                     Pragmatically, the major feature of democracy that one could be pompous of is          RULE OF LAW. Another political theory or doctrine been formulated and              advocated by affable late president of United States of America known as A.V             Decey, and is defined in three categorical meanings. Firstly, it means the                  supremacy of the laws of the country. Thus rules or regulations of family heads,        companies, organizations or non governmental organizations, churches, to mention  but a few, cannot overshadow the laws of the country, hence all the laws of the           country which have parliamentary approval and is being signed by a sitting              president, remains supreme to any other laws, or rules or regulations.                             The third meaning Rule of law is fundamental human rights such as the right to exercise franchise, the right to life and education, freedom of speech and more especially the right to own a property and to inherit a property. It is of no doubt that there are  two major types of inheritance that is practice in Ghana; “thus Maternal inheritance mainly  practiced in Ashanti region and  Paternal inheritance practice in the remaining regions”.                                                                                                    I want to make it clear to Mr. William kwabla Amaglo,the  so-called Amaglo family head accompanied with shabbiest, chaffs  and sycophants, to  understand that being the family head or not, he have no  legal right over properties of TORGBE KOJO AMAGLO  as long as his biological children are alive. l am very optimistic that the hullabaloo, anxieties, perplexities and uncertainties as to whether he  has legal rights over TORGBE KOJO  AMAGLO`S  properties or not has been made                promulgated to him and everyone.                                                                                                                                                                                                                                      

My advise to the said  Prof Francis Tetteh Koku Sefe or any individual, Green Bounty Ltd or any company that the Kojo Amaglo`s land  at Meyikpor  is not for lease. I impregnably believe that no serious individual or company will pay  a pessewa for a land either for sale or lease without seeing the land documents.

Mr William Kwabla Amaglo, the so called  Amaglo family head is leading to lease his grandfather`s Land even when the children of his grandfather are still alive. He is leasing the LAND not because it belongs to his father or mother but because he things he is a family head. A SO- CALLED FAMILY HEAD WITHOUT POWER OF ATTORNEY. ANY ONE WHO PAY HIM A PESSEWA, DO SO AT HIS OR HER OWN RISK.

 

 

Yes the said land belongs to Torgbe Kojo Amaglo where he lived for decades with the WAR THRONE ; TORGBE VORSAH and l believe any spiritually gifted person will  ask whether the WAR THRONE has a hand in the land or not.
