(BY TORDEY GERSHON AMAGLO HOUSE NUMBER K1/11 YORWUTU AVENUE,FORESTRY LANE, KABAKABA HILL,HO -Tel. 0244065452(A product son of KWAMI AMAGLO and SALOME ADZO ADZRAGO; and a paternal grandson of KUDOMOR KWADZO AMEGBETOR AMAGLO).
THE FACT OF THE MATTER
On the 2nd day of September 2018, Messrs. William Kwabla Amaglo, Nicholas Atsu Amaglo and Jacob Adukpo organized a family meeting in Adidome, at Kwami Amaglo’s House, in the name of Kudomor Kwadzo Amegbetor Amaglo Family, which I attended upon invitation. The meeting was chaired by William Kwabla Amaglo. Invitation letter attached.
At the said meeting, there was no itemized agenda but I realized that discussions were focused on the management of the estates of Kudomor Kwadzo Amegbetor Amaglo (Deceased). As a result of this realization, I sought the permission of the chairman, Mr. William Kwabla Amaglo to make a contribution.
MY CONTRIBUTION AND REACTION OF THE ORGANIZERS
My contribution was a brief education on family inheritance issues. I did make a contribution as I quote block “All of us gathered here except Tasi Afafa Kudomor do not have the locus to discuss the management of the estates of Kwadzo Amegbetor Amaglo (Deceased). Others who qualify to do so but were excluded by invitation to the meeting are ; Mr. Emmanuel Kwasi Adigle Amaglo, Mad. Agbonusi Amaglo ,Mr. Kwabla Fudzi Kudomor, Mad. Danyeametor Fudzi Kudomor and Mad.Kporvuvu Hodevor Kudomo”, I was making that contribution bearing also in mind the mandate given to the Kudomor Kwadzo Amegbetor Amaglo Estates Management Committee set up by Mr. Emmanuel Kwasi Adigle Amaglo of which one of the conveners and chairman of the meeting , Mr. William Kwabla Amaglo Chairs.
The education I was giving did not go down well with the organizers and they never waited for me to complete, but interrupted rudely. Mr. Nicholas Atsu Amaglo made a categorical statement as I quote “You know this but went to Tordzenu to sell palm trees on your own accord and did not account for the proceeds but rather used it to satisfy your personal needs”. This, received applause of the organizers and their aids .To my surprise, many of the participants applauded, suggesting to me there was a pre-determined fate regarding the issue.
When the applause died down and, before I continued my submission, I requested the chairman, Mr. William Kwabla Amaglo to permit, Mr. Nicholas Atsu Amaglo to give me the details of the blunted statement he made about me, when I finished with my submission. When I finished, I made the same request but this fell on the deaf ears of the chairman, William Kwabla Amaglo; hence no explanation was given me.
RECENT DEVELOPMENT AND MY ACTION
On Wednesday, 13th March, 2019 I received a telephone call from a member of Aveadre community where Kudomor Kwadzo Amegbetor Amaglo (deceased) owned a parcel of farmland. The caller stated that, some members of Amegbetor Kudomor Kwadzo Amaglo family were in their mist purporting to be there to inform the community about an action to lease Kwadzo Amegbetor Amaglo’s land and in the process to justify their move, Mr. William Kwabla Amaglo made a claim that I, TORDEY GERSHON AMAGLO, have sold quite a number of palm trees on the land and that I am at large and, that has prompted their action. The recent development has informed me to sue the organizers of the September 2nd, 2018 meeting and join Mr. Emmanuel Kwasi Adigle Amaglo to the case.
MR. EMMANUEL KWASI ADIGLE AMAGLO AND HIS CONDUCT
Who: MR. EMMANUEL KWASI ADIGLE AMAGLO is the only surviving son of about 50 children of Kudomor Kwadzo Amegbetor Amaglo (deceased) and a retired public servant among others.
What: On 1st July 2011, Emmanuel Kwasi Adigle Amaglo organized a meeting immediately after performing the funeral rites of his late brother Kwami Amaglo, the immediate past family head, at Mafi Dugame with members of the Amegbetor Kudomor Kwadzo Amaglo family.
At the said meeting, he indicated and indeed formed a committee to document his father Kudomor Kwadzo Amegbetor Amaglo’s Estates for informed management decision. He stated categorically clear that, his aim for this action emanated from the fact that he was not resident at home (MAFI) the natal area of the family and therefore has given recognition to Mr. William Kwabla Amaglo, the youth leadership role he was playing under he Emmanuel Kwasi Adigle Amaglo’s late brother Kwami Amaglo and consequently, appointed him the chairman of the committee.
Membership of the committee includes;
1. Mr. William Kwabla Amaglo, a retired cultural Officer, and family Youth Leader (Chairman)
2. Mr. Jacob Adukpo, a Catechist of EP Church Adidome (financial secretary)
3. Mr. Hammond Quame-Amaglo, an Accountant (Secretary/Registrar)
4. Dr. Newton Agbeko Amaglo, Lecturer of KNUST, Technical consultant (Member)
5. Mr. Gershon Tordey Amaglo, Forestry Commission, Technical consultant (Member)
6. Sgt. Geoffrey Amaglo, a Police officer, Projects coordinator (Member)
7. Mr. Wisdom Kwami Amaglo, Business Executive (Member)
TERMS OF REFERENCE (TOR)
1. To assist locate and document all Amegbetor Kudomor Kwadzo Amaglo’s Estates including human beings and artifacts.
2. To assist promote the utilization of such assets to the benefit of the entire family.
3. To assist carry out development projects where necessary to uplift the image of the family
4. To assist develop strategies towards the protection of such assets
Mr. Emmanuel Kwasi Adigle Amaglo returned to settle permanently at Mafi Adidome his natal home since 2015.
The conduct: Since Mr. Emmanuel Kwasi Adigle Amaglo’s return, he has failed to demand activity and financial report from the said committee due to insubordination of the chairman and has neither dissolved the committee nor constituted a new one. This attitude has lingered on, and has resulted in the conduct of the said 2nd, September 2018 meeting which has led to the current need for this action.
MY INTENTION TO JOIN MR.EMMANUEL KWASI ADIGLE AMAGLO TO THE SUIT
MR.EMMANUEL KWASI ADIGLE AMAGLO is the only surviving son of Kudomor Kwadzo Amegbetor Amaglo (deceased) inheriting him. He has only one surviving half-sister Mad. Agbonusi Amaglo and four direct first cousins who are also considered beneficiaries Kwadzo Amegbetor Amaglo’s Estate.
Like his predecessor Kwame Amaglo, MR. EMMANUEL KWASI ADIGLE AMAGLO has recognized his Father’s Estates as a family asset hence, the committee he set for its management.
However, his action and inactions, his commissions and omissions have potentials that are undermining his good intentions and the ever family dignity enjoyed under the leadership of his predecessor. Thus, the family is gradually disintegrating, a manifestations of the actions of the organizers of that 2nd September, 2018 meeting. MR. EMMANUEL KWASI ADIGLE AMAGLO though has the responsibility to ensure that sanity prevailed in the family for his Father’s Estate to remain serviceable to the family after his death, has neglected this responsibility making some grandsons of Kwadzo Amegbetor Kudomor Amaglo particularly the organizers of the said 2nd September,2018 meeting, to take him for granted as could be sited in several provocative letters written to him by Mr. William Kwabla Amaglo, the appointed chairman of the committee, promoting himself from youth leader to FAMILY HEAD over Emmanuel Kwasi Adigle( Letters attached).
Considering the above scenarios, it is very important to join Mr. Emmanuel Kwasi Adigle Amaglo to the case, in his own interest and in the interest of family cohesion and sustainability.
MY CLAIMS AND REQUEST
I am by the above facts requesting:
1. Mr. Nicholas Atsu Amaglo and the other organizers of the 2nd September 2018 meeting, the removal of the damage caused my image by the statement he attributed to me and continue to propagate and, the restoration of my reputation, as well as paying for such damage.
2. that the organizers of the September 2nd 2018 meeting be restrained from holding themselves as leaders of the Amegbetor Kudomor Kwadzo Amaglo family beyond the authorities of MR. EMMANUEL KWASI ADIGLE AMAGLO and the committee he set up and, place perpetual injunction on their purported management activities of Amegbetor Kudomor Kwadzo Amaglo’s Estates; particularly the leasing of any estates of Kwadzo Amegbetor Kudomor Amaglo Estate as in the case of the referred to land situated at Aveadre Sentse.
3. that Mr. EMMANUEL KWASI ADIGLE AMAGLO be compelled to demand a written activity and financial report from Mr. William Kwabla Amaglo, the Chairman of the Kwadzo Amegbetor Kudomor Amaglo Estate Management Committee he set up, for that period of time to date, to inform management decision.
4. that the purported committee William Kwabla Amaglo set up outside the authority of MR. EMMANUEL KWASI ADIGLE AMAGLO on the estates of Amegbetor Kudomor Kwadzo Amaglo be declared null and void and of no effect. William Kwabla Amaglo also be compelled to place himself under the authority of EMMANUEL KWASI ADIGLE AMAGLO and remained within the confinement of the committee he chairs and desist from his self -styled family headship and its misplaced applications.
5. that Mr. EMMANUEL KWASI ADIGLE AMAGLO be compelled to play his family headship role well to utilize the report to be produced from the committee, for arrangements for the management of the estate that renders benefits from his father’s estate as he intended.
6.that until such a time that EMMANUEL KWASI ADIGLE AMAGLO dissolves the committee he set up and constitute a new one, the committee remains the recognized one set up to assist in the management his father’s estate, if he still thinks his father’s estate should remain a family managed property in perpetuity whether in his lifetime or after his death . The committee should also be compelled to within a stipulated time to come out with a democratic management arrangement to forestall any arbitrary decision making.
MY INTEREST
My interest in bringing up this law suit which is also the interest of other family members of great concern is as follows;
-
In the entire Amegbetor Kudomor Kwadzo Amaglo family, it is only the estate of EMMANUEL KWASI ADIGLE AMAGLO’s father that is being considered as family estate even though other people’s fathers, (including the organizers of the 2nd September,2018 meeting) in the same family have assets for their individual children. In effect the said estate has been managed as such over time. if EMMANUEL KWASI ADIGLE AMAGLO, the last son of Amegbetor Kudomor Kwadzo Amaglo is not compelled to institute good governance, the estate would remain the center of confusion in the family.
-
Under the management leadership of late Kwami Amaglo, the immediate past family head, some grandchildren have supported him enormously in financial terms in the protection of the estates and some long- term investments such as afforestation, and that these must be documented appropriately. Any inaction of Mr. EMMANUEL KWASI ADIGLE AMAGLO this time round is a recipe for anarchy and disorder which is likely to undermined the peace and reputation that this family has enjoyed in the past under the leadership of his predecessors.
-
Since Kudomor Kwadzo Amegbetor Amaglo ‘s(deceased) land has been used by several family members, any arbitrary decision making as the one emanating from the 2nd September,2018 meeting would negatively affect the livelihoods of many who depended on it.
-
Some members of the family including I, TORDEY GERSHON AMAGLO, have invested in farms on the referred to lands under the permission of the immediate past family head and that if arbitrary steps are taken on the land as done by the organizers of the 2nd September,2018 meeting, such persons would suffer greatly. The identified organizers are noted to have nothing at stake on these lands and therefore cannot take informed decision concerning the land. They are known to have acquired and registered land in their names for their children and therefore are not mindful of the long term effect of their actions on the vulnerable ones in the family. The case for Mr, William Kwabla Amaglo
He was a member of a team that organized Kudomor Kwadzo Amaglo Amegbetor Family meeting on2nd of September,2018, which I participated in though I considered it illegal; but for the purpose of evidence gathering on the insurbordination behavior of William Kwabla Amaglo towards Mr. Emmanuel Kwasi Adigle Amaglo the only surviving son of Kudomor Kwadzo Amaglo Amegbetor and head of the family.William Kwabla maglo did chaired the meeting.
A scornful remarks from William Kwabla Amaglo to a contribution I made, attracted several derogatory remarks from some participants in the meeting notably Messrs Chriistian Fovi Amaglo and Oliver Husunu Amaglo. The quotes are as below:
Husunu Oliver Amaglo:” because we are fools that is why you have succeeded in claiming Newton’s benefits and misused, I am going to deal with you accordingly; Yes I do not know what is wrong with you ,having claimed the monies meant for orphans, you went ahead to sell our palm trees several times at Tordzenu and personally used the money wait and see what is ahead of you”
Christian Fovi Amaglo.
I waited patiently and after the meeting I made formal appeal to William Kwabla Amaglo the chaired you after the meeting in the presence of Messrs. Kennedy Tordea Amaglo and Nicholas Atsu Amaglo to demand from the two in question to substantiate the allegation since it happened under your jurisdiction as a convener and chairman of that platform. I have waited for seven good months without any response from you
BY JOHN HAMMOND AMAGLO
.
At the said meeting, under your chairmanship you gave me the floor to contribute to your numerous discussions on family issues which attracted my attention. Your blunt ant reaction to my contribution attracted derogative remarks from Messrs. Christian Fovi Amaglo and Oliver Husunu Amaglo as follows quote” because we are fools that is why you have succeeded in claiming Newton’s benefits and misused, I am going to deal with you accordingly” Husunu Oliver Amaglo.Again quote”Yes I do not know what is wrong with you ,having claimed the monies meant for orphans, you went ahead to sell our palm trees several times at Tordzenu and personally used the money wait and see what is ahead of you”Christian Fovi Amaglo. These statements attracted the applause of Miss Celestine Amaglo and Mr.Thomas Amaglo quote”good repeat that” thus throwing the whole sitting in a state of disorder for almost thirty minutes with unqualified statements coming from all angles of the sitting without your control. Indeed, because I realized that you were vulnerable at the time, I waited patiently and made formal appeal to you after the meeting in the presence of Messrs. Kennedy Tordea Amaglo and Nicholas Atsu Amaglo to demand from the two in question to substantiate the allegation since it happened under your jurisdiction as a convener and chairman of that platform. I have waited for seven good months without any response from you.
This letter serves as a final reminder on the matter for your response within two weeks from the date of this reminder. Please note that failure to react to this humble reminder will lead vivid consultation with my solicitor for an unprecedented joint civil action against you and your allied.
Thanks.
